Terms and Conditions

These Terms govern your use of GetSetSales, a platform for sending, automating, and tracking WhatsApp Business campaigns, operated by Digiturtle Marketing (OPC) Private Limited, a company incorporated in India ("we", "our", "us"). By creating an account, you agree to these Terms.

The service

GetSetSales lets you connect a WhatsApp Business number, import and manage contacts, send template-based campaigns, build automated conversation flows, and view a shared inbox for replies. Messages are delivered through Meta's WhatsApp Business Platform; your use of WhatsApp messaging through our platform is also subject to WhatsApp's Business Messaging Policy.

Your account

• You must provide accurate information when signing up, and keep your login credentials secure.
• You are responsible for all activity that happens under your account, including anything sent by teammates you invite.
• You must be authorized to connect and message customers through the WhatsApp Business number(s) you add to your account.
• You must keep your password and any API keys confidential, and tell us at support@getsetsales.in as soon as you suspect someone else has access to your account.

Until you tell us, activity carried out through your credentials is treated as yours. That includes messages sent, wallet balance consumed, and charges raised by Meta. We will help you secure a compromised account — revoking sessions, rotating API keys and disconnecting numbers — but we cannot reverse messages already delivered or recover amounts already spent.

Acceptable use

You agree not to use GetSetSales to:

• Send unsolicited messages to people who have not opted in to hear from your business.
• Send content that violates WhatsApp's own policies, applicable law, or infringes on anyone's rights.
• Attempt to circumvent opt-out requests — a contact who unsubscribes from your business must not be messaged again.
• Interfere with or attempt to disrupt the platform's infrastructure.

We may suspend or terminate accounts that violate these terms, or whose WhatsApp messaging quality falls below Meta's own thresholds and puts the shared platform's standing at risk.

Billing

GetSetSales operates on a prepaid wallet: you add credit, and usage (per delivered message, at the rate shown in the product) is deducted from your balance. Top-ups are processed via PayU, and applicable taxes are charged as required under Indian law. Unused wallet balance is not refundable except as required by law or at our discretion — see our Refund & Cancellation Policy for the full details.

Meta's charges are separate and are not ours. WhatsApp conversation charges are set by Meta and billed by Meta directly to the payment method on your own WhatsApp Business Account, under your agreement with Meta. That money never passes through GetSetSales: we neither collect it nor hold it, and we cannot refund, credit, reverse or dispute it. Your GetSetSales wallet covers our platform fee only. Queries about Meta's charges, pricing changes or billing disputes go to Meta.

Availability

We aim to keep the platform available and reliable, but we do not guarantee uninterrupted service — this includes outages or changes on Meta's WhatsApp platform, which are outside our control.

Limitation of liability

GetSetSales is provided "as is." To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the platform, including loss of messages, contacts, or business resulting from downtime or third-party (including Meta) service interruptions.

Our total liability is capped at your wallet balance. To the maximum extent permitted by law, our entire aggregate liability to you for any and all claims arising out of or relating to the platform will not exceed the unused GetSetSales wallet balance held in your account at the time the claim arose. This is the sole and exclusive remedy available to you.

We are not liable for amounts charged by Meta. The cap above applies only to your GetSetSales wallet. Charges raised by Meta against your WhatsApp Business Account are outside it entirely and are never recoverable from us, in any amount, on any basis. This applies however those charges arose, including where they were run up through your account by someone acting without your permission.

Unauthorized access. If your account is accessed by someone other than you or your invited teammates, we are not liable for the consequences, including messages sent, wallet balance consumed, Meta charges incurred, or damage to your WhatsApp quality rating or messaging limits. This does not apply where the unauthorized access resulted from our own failure to meet the security obligations we owe you by law.

Nothing in these terms limits or excludes liability that cannot be limited or excluded under the laws of India, including liability for fraud, willful misconduct, gross negligence, or death or personal injury caused by negligence. Where any part of this section is held unenforceable, the rest continues to apply.

Termination

You may stop using GetSetSales and close your account at any time. We may suspend or terminate your access for breach of these Terms, non-payment, or where required by law or by Meta's own platform policies.

Governing law

These Terms are governed by the laws of India, and any disputes are subject to the exclusive jurisdiction of the courts in Uttarakhand, India.
